Terms and conditions

These terms and conditions apply to all agreements and services provided by MyLittleGuess VOF, established in Amsterdam and registered with the Chamber of Commerce under registration number 85479179, hereinafter: MyLittleGuess.
Definitions
- Customer
- the natural person who is not acting in the exercise of a profession or business and who enters into a distance agreement with MyLittleGuess.
- Day
- calendar day.
- Durable medium
- any means that enables the Customer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
- Right of withdrawal
- the option for the Customer to withdraw from the distance agreement within the cooling-off period.
- Distance agreement
- an agreement concluded within a system organised by MyLittleGuess for the remote sale of products and/or services, using one or more means of distance communication up to and including conclusion of the agreement.
- Means of distance communication
- a means that can be used to conclude an agreement without the Customer and entrepreneur being in the same room at the same time.
- Terms and Conditions
- these Terms and Conditions of MyLittleGuess.
Applicability
- These terms and conditions apply to every offer from MyLittleGuess and to every distance agreement and order concluded between the entrepreneur and the Customer.
- Before the distance agreement is concluded, the text of these terms and conditions will be made available to the Customer. If this is not reasonably possible, it will be indicated that the terms and conditions can be inspected at MyLittleGuess and will be sent free of charge upon request.
- If the agreement is concluded electronically, these terms and conditions may be made available electronically in such a way that the Customer can easily store them on a durable medium.
- If specific product or service conditions also apply, the Customer may rely on the applicable provision that is most favourable to them in the event of conflicting terms.
- If one or more provisions are wholly or partly void or annulled, the agreement and these terms and conditions will otherwise remain in force.
- Situations not covered by these terms and conditions must be assessed in the spirit of these terms and conditions.
- Uncertainties about the interpretation or content of provisions must be interpreted in the spirit of these terms and conditions.
The offer
- If an offer has a limited validity period or is subject to conditions, this will be expressly stated in the offer.
- The offer is non-binding. MyLittleGuess is entitled to change and adjust the offer.
- The offer contains a complete and accurate description of the products and/or services offered. Obvious mistakes or errors in the offer do not bind MyLittleGuess.
- All images and specifications in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.
- MyLittleGuess cannot guarantee that displayed colours exactly match the actual colours of the products.
Each offer contains sufficient information to make clear to the Customer what rights and obligations are attached to accepting the offer, in particular:
- the price including taxes;
- the dimensions;
- any shipping costs;
- how the agreement will be concluded;
- the method of payment, delivery and execution;
- the period for accepting the offer;
- whether the agreement will be archived after conclusion and how it can be consulted;
- how the Customer can check and correct the data provided before concluding the agreement;
- any other languages in which the agreement can be concluded;
- the codes of conduct to which MyLittleGuess has committed itself;
- the minimum duration of the distance agreement in the case of a continuing transaction.
The agreement
- The agreement is concluded when the Customer accepts the offer and meets the conditions set for that offer.
- If the Customer has accepted the offer electronically, MyLittleGuess will promptly confirm receipt of acceptance electronically.
- If the agreement is concluded electronically, MyLittleGuess will take appropriate technical and organisational measures to secure the electronic transfer of data and provide a secure web environment.
- Within legal limits, MyLittleGuess may check whether the Customer can meet their payment obligations and may refuse an order or attach special conditions to the execution of the agreement.
- MyLittleGuess will provide the relevant information with the product or service, including the visiting address, information about the right of withdrawal, guarantees, after-sales service and any cancellation requirements.
- Every agreement is concluded under the suspensive condition of sufficient availability of the relevant products.
Exclusion of the right of withdrawal
MyLittleGuess may exclude the Customer's right of withdrawal for the products described below. The exclusion only applies if MyLittleGuess clearly stated this in the offer, or at least in good time before the agreement was concluded.
Exclusion of the right of withdrawal is only possible for products:
- created by MyLittleGuess in accordance with the Customer's specifications;
- that are clearly personal in nature;
- that by their nature cannot be returned.
The price
- During the validity period stated in the offer, prices will not be increased, except for price changes resulting from changes in VAT rates.
- The prices on the website include VAT.
- All prices are subject to printing and typesetting errors. In the event of such errors, MyLittleGuess is not obliged to deliver the product at the incorrect price.
Conformity, warranty and delivery
- MyLittleGuess guarantees that the products and/or services comply with the agreement, the specifications stated in the offer and reasonable requirements of soundness and usability.
- Any warranty provided by MyLittleGuess, a manufacturer or importer does not affect the Customer's statutory rights.
- MyLittleGuess will exercise the greatest possible care when receiving and executing orders.
- The place of delivery is the address provided by the Customer to MyLittleGuess.
- Accepted orders will be executed with due speed and no later than 30 days, unless the Customer has agreed to a longer delivery period.
- All delivery periods are indicative. The Customer cannot derive rights from stated periods.
- In the event of dissolution, MyLittleGuess will refund the amount paid as soon as possible and no later than 14 days.
- If delivery of an ordered product proves impossible, MyLittleGuess will make efforts to provide a replacement item.
- The risk of damage or loss remains with MyLittleGuess until delivery to the Customer or a previously designated representative.
Payment
- The Customer must make payments according to the payment methods indicated in the order process and, where applicable, on the website.
- The Customer must promptly report inaccuracies in payment details provided or stated to MyLittleGuess.
- If the Customer does not pay on time, they will be in default after a further 14-day period and MyLittleGuess may charge statutory interest and extrajudicial collection costs.
Complaints procedure
- MyLittleGuess has a sufficiently publicised complaints procedure and handles complaints in accordance with that procedure.
- Complaints about the performance of the agreement must be submitted fully and clearly within 7 days after the Customer has discovered the defects.
- Complaints will be answered within 14 days of receipt. If more time is required, the Customer will receive an acknowledgement and an indication of when a more detailed response can be expected.
- If a complaint is found to be justified, MyLittleGuess will, at its discretion, replace or repair the delivered products free of charge.
Applicable law
Agreements between MyLittleGuess and the Customer to which these terms and conditions apply are governed exclusively by Dutch law, even if the Customer lives abroad.
The Vienna Sales Convention does not apply.
Additional or deviating provisions
Additional or deviating provisions may not be to the detriment of the Customer and must be recorded in writing or in such a way that they can be stored by the Customer in an accessible manner on a durable medium.
